When Is a Lease Required to Be Registered: An Illustrative Scenario in Chennai

By Mishpat Legal Consultants

Updated

What follows is a fictional, illustrative scenario intended only to demonstrate how the general rules above apply to a typical set of facts. It does not describe a real person, client, or case.

The illustrative scenario

A tenant in Chennai is trying to understand when is a lease required to be registered. The Registration Act's rule on leases over one year, and why an unregistered long-term lease can cause problems.

Illustrative, not an actual client matter

The question

This raises an obvious question:

Do I need to register a rental agreement?

How the general rule applies

Under s.17(1)(d) of the Registration Act 1908, a lease from year to year, for a term exceeding one year, or reserving a yearly rent, must be registered.

As a general rule, an unregistered lease that should have been registered generally cannot be used as evidence of its own terms in a dispute, which is why many 11-month leave-and-licence agreements are used instead of a registered lease.

If the lease is for more than one year, or is from year to year, or reserves a yearly rent, s.17(1)(d) of the Registration Act requires registration. Shorter leave-and-licence agreements are often used specifically to avoid this requirement.

What often gets missed in situations like this

  • Signing a lease for more than a year without registering it, then finding it difficult to rely on its terms in a dispute.
  • Assuming an 11-month agreement avoids all formality — many states still require stamping and, depending on the state, some form of registration or intimation.

Where this scenario is set (Chennai)

  • The High Court with jurisdiction is the Madras High Court.
  • Matters at the district level are generally handled at the Chennai City Civil Court or Small Causes Court.
  • The applicable rent law is the Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017.
  • Registration is handled through TNREGINET.

As noted above, this scenario is a constructed illustration used to explain the general rule — it does not describe a real client, case, or outcome.
