Registration Is Not the Same as Clear Title: Frequently Asked Questions

By Mishpat Legal Consultants

Updated

Here is a general overview of common questions on registration is not the same as clear title under Indian law.

Before the frequently asked questions

In K. Gopi v Sub-Registrar (7 Apr 2025) and Samiullah v State of Bihar (7 Nov 2025), the Supreme Court struck down state rules that tied registration to proof of a particular title chain or mutation record, while also flagging that registration itself does not establish or guarantee title.

In Samiullah, the Supreme Court asked the Law Commission to examine conclusive titling and blockchain-based land records as a longer-term solution to this gap.

Frequently asked questions

If a sale deed is registered, does that mean the seller definitely owned the property?

Not necessarily. Registration formally records the transaction but, as the Supreme Court has noted in recent rulings, does not by itself guarantee that the seller had valid, marketable title. Independent title verification remains important.
